We do not guarantee that:

  • Generated content will achieve any particular result
  • The Service will meet all your requirements

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PITCHPROMPT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

9. Indemnification

You agree to defend, indemnify, and hold harmless PitchPrompt and its affiliates from any claims, damages, or expenses (including attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your infringement of any third-party rights

10. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.

11. General Provisions

11.1 Entire Agreement

These Terms constitute the entire agreement between you and PitchPrompt regarding the Service.

11.2 Severability

If any provision is found invalid, the remaining provisions remain in full effect.

11.3 No Waiver

Our failure to enforce any right does not constitute a waiver of future enforcement.
